A commission has been established to analyze the Emergency State declared by the President of Chile, Mr. Sebastian Piñera.
The commission has asked a constitutional lawyer, Mr. Jaime Bassa to issue an statement.
Summarized, he states the following
1.- what is happening at the moment is that an exception to the exceptional state is what best describes the situation. What is happening on the streets of Chile has absolutely no constitutional support and is pure factual State Violence. Being very responsible with the wording, can be said that the constitutional norm establishes different ways to execute this exceptionalism. They can be gradually selected according the severity of the emergency: from external to internal shock.
This means that the limit of citizen guarantees restrictions it will depend on the seriousness of the threat. This is a key issue. What has been declared here is an emergency state, and this facilitates ONLY the President, to limit the exercise of freedom of movement and reunion of the population.
2.- He can delegate this function on a local authority, but this has not happened.
3.- however factually other liberties have been severed: information and press freedom, freedom to express opinions, against the right to peaceful protest at home. People are being detained in places that have not been authorized by law to serve to this purpose, people have been taken prisoners from their homes. This means that factually the military institutions is acting with no control and as if martial law had been declared, which is not true, ONLY an emergency state has been declared, as above described.
This is all very dangerous and mainly illegal.
5.- This law was originally issued in 1985 and reformed in 1990. This is the first time this law is used for a political situation, as before this time it has been only been used in catastrophe instances; earthquakes, floods, tsunamis, fire, etc
6.- actual curfew is also illegal and people who disobey it are not legally committing a crime, and should not be detained, it is an offense to be punished only by fineWhat the initial twitter video shows is exactly the abuses currently being committed by the chilean armed forces against the population, totally illegal and with no political responsibility!!

My intuition tells me that this all has a lot to do to change the legislation to make if fit for the TPT. I think the establishment, PC included are behind this emergency state, but now they are losing control of it.

When the protests erupted recently in Ecuador, I put out some comments. I asked for someone to run with them, to gain the protestors – real protestors, with a very genuine grievance – some international exposure which they weren’t getting. Saker did – my respectful thanks.

A young man, in jeans, with a blue backpack was lying face down unmoving. A flotilla of motorbikes with black clad police – faces hidden by helmet masks – were taking it in turns to beat him, kick him, thrash him. As new ones turned up, the old took off.
Eventually it seems the beatings stopped. The young man didn’t move. I couldn’t see if he was alive or dead.
This was here, in Ecuador.

TMWNS – Thank you for your considered response. You ask what I suggest as an adequate response. My short answer goes something like this. Authentic Marxist Socialism integrated into a purified and authentic culture of Christian spirituality. By authentic Christianity I mean a spiritual culture that is cleansed of the Roman distortion that drives fear and division between rulers and ruled. More along the lines of Celtic Christianity that is holistic and nature centered. That being a form of Christianity that integrates and includes the leading role of the insurgent divine feminine principle. At this stage very few people are sufficiently cultured to recognize that Socialism is a manifestation of the divine feminine. The patriarchal conditioning precludes that understanding. And guarantees hostility to it. I see this as a living mythic movement in our times that the collective mind is only grasping in fragments as of yet. Joseph Campbell referred to it as the only myth worth talking about. That being the myth of world unity. As I see it the myth of world unity must unite the universal feminine principle with the authentic content of patriarchal spiritual culture (i.e., Christianity). If this is done then the path forward to a vision of democratic and spiritually enlightened Socialism that meets the needs of world unity is possible. As of yet the creative combination of these necessary elements has not congealed in the mass mind – hence no solution appears possible as of yet. I know that from experience, but I don’t know whats going on in Chile! This article is the first report of any substance I am encountering on the subject.
However, what you report of damage to infrastructure (subway system) is probably not known to anyone here.
Such damage would harm the nation and the people in the nation so who could support that? Show the video evidence if you have it!

You should look at the clothing, and skin color; that is class markers.
The chilean cops have been given carte blanche (or maybe even direct orders) to punish the lower classes.
The goal is to instill fear in the lower classes, in order to impose them whatever the IMF dictates.
But fear and violence only works when used in small dosis, as a menace, instead of actually doing it.
When you are at actually doing it, it backfires, as people will start to self-defend themselves.

People in South America are just sick and tired of “austerity” and other assorted neoliberal sorry excuses to keep the largest part of the population in shambles.
Chile has been, for decades long, the IMF/World Bank’s “poster boy”, shown for the neighbouring coutries of Latin America as THE model of economical and political stability, all the while impoverishing their own population.
Chilenians finally decided to scream “enough is enough!”, and we’re witnessing how things really are down there in that (suposed to be) tecnocrathical paradise.
Argentina went the same way. Macri got kicked out in the first round of the presidential election, yesterday, but not before tiyng his country with an enourmous amount of debt with (guess who?) the IMF, leaving for the next government the whole pack of economical consequences.
Ecuador is facing social unrest triggered exactly by the very same kind of economical policies, and just after they’ve signed a deal with the very same IMF.
Brasil is being attacked by ruthless and shameless neoliberal politicians, who are destroying the welfare provisions written in our Constitution for the sake of “modernization” and “budget balance” – that kind of lies used everywhere with the same goals. The difference here is the lack of public awareness about the long term economical consequences of those policies. We’ve got a population that is plainly brainwashed by a few communicational oligopolies. Simply there’s no real debate about alternative public policies. Any information that goes against the so called “badly needed reforms” gets to pass the silent censorhip.
Talking about propaganda, it seems that all over Latin America we’ve got the same kind of words used to label those who stand up against neoliberal policies: “communist”, “socialist”, “russian/chinese/cuban/venezuelan asset”, “foreign-sponsored terrorist” and so on. This 50’s cold war language didn’t came out of the blue and surely is no coincidence.

The protests in Chile, and previously in Ecuador are motivated by the criminal wealth-extracting policies of never-ending rounds of “austerity” measures that basically condemn people to increasing levels of misery. The US is not exempt from this. It’s now common to see all over the country (even in generally affluent parts such as the SF Bay Area) people living in small congregations of “tent cities” and tent hamlets. You see them often as soon as you exit a freeway. For some reasons, Americans don’t protest much about this, but it is a pretty obvious case of gradual societal collapse.
The Yellow Vests in France were/are motivated mainly by similar concerns.
The Barcelona “protests” do not belong in this category at all. They belong entirely in the Hong-Kong, Maidan, Liberal Rusian etc, kind of rainbow pussy riots that we have become used to, masquerading as “struggles for freedom”. It is surprising that this is not more readily detected by Saker readers. The vandalizing segments in Barcelona are pretty well organized, they come equipped with tools to dig up sidewalks and pavements, even cobblestones, as weapons they can hurl at police and shop windows. But unlike Palestinians, their motives are totally unconvincing.

The ostensible reason this time is that they are angered by the sentences meted out to the organizers of their 2017 attempt to create their own apparatchik ethnocratic republiquette, so free and so rainbowy. Obviously this kind of behaviour would be dealt with much more decisiveness by the anti-riot forces of many states, for example France. All you have to do is compare how they dealt with the generally well-mannered Yellow Vests, who were not motivated by any such petty concerns and did not engage in wanton vandalizing.
The Catalan separatists are ideologically very akin to nationalist movements like the Flemish, the northern Italians and so on. It has nothing to do with exploitation or colonization. It is a rebellion of the bratty spoiled. The fiery segments can afford to party all night throwing pieces of sidewalk and setting things on fire, as they are usually unemployed, and classes are cancelled for these celebrations. So they can sleep during the day.
In Catalonia all polls show a large gap in income between separatist and unionists. And also by profession. Public officials, employees and administrators working under the direction of the Catalan government are far more likely to be independentists.
To make it short, the European Union has been promoting an old idea hatched in Nazi Germany: the “Europe of the Regions”, without mentioning where it came from. This relentless campaign goes hand in hand with promoting the idea that European nation states should transfer to Brussels whatever remaining shreds they still have of national sovereignty, the goal being the dismantling of the nation-states, especially the larger ones. In this respect Spain stands out as an irresistible target, what you might call a “sitting duck” or “low hanging fruit” to be broken into a bunch of token statelets and completely incorporated into the globalist financial steamroller of the UE. The nourishing of various nationalist movements, especially in Catalonia, has worked very well during the last 30 years, in combination with a campaign to convince Spaniards of their various deficiencies in Europness and modern neo-liberal democratic practices. The initial idea to solve this will soon be presented as a process of “federalization”, as a prelude for final dismemberment. It is probably too late for Spain to do much about it, what with a confused population who keeps thinking of the EU as a great source of future happiness. In this, both Catalonians and the rest of Spaniards are fully united. And they will get exactly what they deserve for allowing themselves to be so brainwashed.
The campaign to give up more sovereignty is also very active in France. But I doubt it will ever succeed, France having worked much harder at developing a firmer sense of national unity. They may wake up before it’s too late.
People should stop confusing and conflating disparate things. What is going on in Chile has nothing to do with Catalonia. Nothing at all. It has everything to do with what went on in Ukraine. Although there again you have to keep differences. From video footage of the Maidan “riots” you could see the “fighting protesters” consisted at times of actual battalions with fighting gear. By their physical appearance and the way they fought you could tell they had been selected and trained for that purpose. The cobblestone throwers and arsonists in Barcelona are also organized and equipped, but not at the level of ferocity of those Maidan groups. But the police are caught in a similar dilemma. They don’t want to appear too heavy-handed in dealing with the sacred right of protesters to vandalize infrastructure and attack police, and certainly don’t want martyrs.
