On July 22, 2021, the Russian Federation filed an interstate complaint with the European Court of Human Rights against Ukraine under article 33 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
The complaint concerns the following main groups of violations::
– responsibility of the Ukrainian authorities for the death of civilians, illegal imprisonment and ill-treatment of people, including those that took place on Independence Square in Kiev (Maidan) and in the House of Trade Unions in Odessa in 2014, as well as in the Donbass during the so-called “anti-terrorist operation”;
– the practice of suppressing freedom of speech and persecuting dissenters by banning the work of mass media, Internet platforms, persecuting journalists (Russian, Ukrainian and other states), politicians and ordinary citizens;
– policy of discrimination against the Russian-speaking population, ousting the use of the Russian language from the public sphere, primarily from the sphere of secondary and higher education and the consumer service system;
– discrimination policy of Russian companies and entrepreneurs;
– loss of life, damage to health and destruction of property as a result of shelling by the Armed Forces of Ukraine of the adjacent territory of the Russian Federation;
– depriving residents of certain territories of the south-east of Ukraine of the opportunity to participate in elections to central authorities;
– blocking of the North Crimean Canal as the main source of fresh water for residents of the Crimean Peninsula;
– attacks on diplomatic, consular and other representations of the Russian Federation in Ukraine;
– the crash of Malaysian Airlines flight MH17 on July 17, 2014, due to the failure of the Ukrainian authorities to close the airspace over the combat zone, and the death of 298 people – all passengers and crew members;
– refusal to provide the necessary legal assistance to the Russian investigative authorities in the investigation of crimes committed.
The appeal is intended to draw the attention of the European Court and the entire international community to the gross and systematic violations of human rights by the Ukrainian authorities, record numerous facts of criminal acts in the international legal field, force the Ukrainian authorities to stop committing them, conduct a proper investigation and immediately bring the perpetrators to justice, and restore peace and harmony on the territory of Ukraine.
Some of the claims of the Russian Federation relate to violations committed by the Ukrainian authorities directly in relation to Russian citizens, among whom there are dead and wounded. On the territory of Ukraine, a significant number of Russian citizens are subjected to ill-treatment, their property is destroyed or damaged, and Russian businesses are discriminated against. In the immediate vicinity of the Russian border, the Armed Forces of Ukraine are conducting military operations that pose a real threat to the lives and health of Russian citizens living in the border regions, and force thousands of Ukrainian citizens to seek refuge on Russian territory.
The Russian Federation’s complaint contains a detailed description of the process of unconstitutional change of power in Ukraine and the promotion of nationalist forces to Ukrainian State bodies, which was the main reason for the subsequent mass violations of the Convention and its Protocols.
The complaint requests the ECHR to apply interim measures in accordance with rule 39 of the Rules of Procedure, obliging Ukraine to immediately stop such blatant violations as blocking the flow of fresh water to Crimea, restricting the rights of national and linguistic minorities, including free access to general and higher education in their native language, banning broadcasting of Russian-language television and radio channels, restricting access to Internet platforms and printed publications in Russian.
I’m very happy this is being done. I think Victoria Nuland, Samantha Powers, Christia Freland, Hilary Clinton, Uncle Joe, and Obama have a lot to answer for .

if you want to demonstrate to the world that the european union as emblematic of this court does NOT abide by the universal idea of the rule of law RATHER it codifies its OWN political version of the rule of law then this lawsuit is a perfect hammer to bang on their door and watch them wriggle out from under this without deciding the suits merits or more typical of them siding with ukraine.
Chalk this up to a perfunctory “for the record” appeal to putative “authorities” to actually do their job in a time of US sanctioned lawlessness. It will be meaningless in the short term, but perhaps somewhat more meaningful in the longer run. It had to be done, but it will probably have little or no effect.
No effect? Lunch was served, the crimes are now public and detailed………….what the Russians have done is serve notice, giving them complete legal cover to intervene should they feel it necessary.

I’m just saying that “legal” doesn’t mean anything anymore in the current lawless (or the laws are what the hegemon says they are) environment. That said, it’s a formality that must be performed regardless.
I have been waiting for this for some time.
It is a legal procedure / formality that I anticipated Russia would need to take if the Russians planned their own version of a “Humanitarian Intervention” in another country – that the west are so fond of.
This legal procedure / formailty is doomed to fail, even if it reaches the Courts, but all parties know that this legal procedure will fail, and that nothing ‘on the ground’ will be resolved from it.
It is a shot accross the bow to the West that a significant portion of the population of Ukraine are being “oppressed” and denied “basic freedoms and democracy”, to the point that “disidents” are being “terrorists” and murdered by thier own government.
In order to prevent further destruction of “basic Human Rights, Freedoms, and Democracy”, a Lawful (under International law) “Humanitarian Intervention” may be required to protect the opressed indiginous populations and thier culture, history, lands, and language from a “Brutal Rogue Regime” hell bent on murdering them and destroying thier culture and history. A “Brutal Rogue Regime” which fails to follow international law and even international peace keeping agreements such as Minsk.
In my opinion, the Russians are now preparing the Legal ground to be “asked in” by the people of Eastern Ukraine as peace keepers – to move in physically (“Kinetic Action”) to Eastern Ukraine to prevent the genocide of the oppressed indiginous population by the “Brutal Rogue Regime” based in Kiev in a version of the Wests “Humanitarian Intervention” which the west had planned to do in Kiev as soon as the Russians crossed the borders a few ago – or so they thought.
This is a great Judo move by Russia. Next step is the UN, then Russian “sanctions” on Kiev (perhaps shutting off gas and oil in the winter now that NS2 is almost ready).
I was thinking the exact same thing, very well thought out and presented argument for ending the agony of Ukraine and the suffering of the Slavic people.
Unfortunately Russia was weak and could barely hold themselves together in the 1990ies, with Yeltsin as their president. Otherwise they could have prevented the Yugoslav wars, where Slavs shot slavs, brothers and sisters killing each other. What a madness.
Luckily times changed, and now Mother Russia can protect the Slavic people around the world, as she did in the 19th century.

Actually, they’re not stupid. Filing this interstate complaint with the European Court of Human Rights – for them it’s a win-win situation.
If the ECHR actually does its job, as advertised, and the ukies are pronounced guilty as charged, the russians may have legal ground to intervene officially, openly and, may be, militarily in Ukraine, if the ukies fail to comply with ECHR.
If the case is dismissed (most likely), it would expose that court as a scam.

I expect the ECHR will be outed as a hypocritical butt naked king with no clothes.
If by some miracle the ECHR is still a standard bearer of international law despite heavy breathing down their necks from Washington, London & Brussels, in other words if it has not drowned in the “rules based international order” cesspool like the OCPW has – which I doubt very much – then this article sums up what to expect: zero compliance from Kiev.
As others have pointed out, regardless of the ECHR’s legalistic outcome, this is RF preparing for economic sanctions and gas flow shutdown followed by a peacekeeping mission grounded on international law and backed by lots of scary standoff weapons.
If there was any justice in the West, HRC, Obomber, and Nuland would all be under arrest to stand trial in the ICC as murderous war criminals.
Fat chance…the West locks up whistleblowers and heroic investigative journalists to such an extent that we now have an institutionally contrived and widely established fear of the truth.

New inter-State application brought by Ukraine against Russia
The Government of Ukraine has lodged a new application with the European Court of Human Rights
against the Russian Federation. The case concerns the Ukrainian Government’s allegations of an
ongoing administrative practice by the Russian Federation consisting of targeted assassination
operations against perceived opponents of the Russian Federation, in Russia and on the territory of
other States. Four inter-State cases brought by Ukraine against Russia are currently pending before
the Court.
On 19 February 2021 the Government of Ukraine lodged a new inter-State application against the
Russian Federation under Article 33 (Inter-State cases) of the European Convention on Human
Rights. This is the ninth inter-State application lodged by Ukraine against the Russian Federation. It
has been registered under application no. 10691/21.
The application concerns the Ukrainian Government’s allegations of an ongoing administrative
practice by the Russian Federation consisting of State-authorised targeted assassination operations
against perceived opponents of the Russian Federation in Russia and on the territory of other States,
including other member States of the Council of Europe, outside a situation of armed conflict.
The Ukrainian Government also alleges an administrative practice by the Russian Federation of
failing to investigate these assassination operations and of deliberately mounting cover-up
operations aimed at frustrating efforts to find the persons responsible.
The Ukrainian Government alleges a violation of both the substantive and procedural aspects of
Article 2 (right to life) of the Convention.

Other cases
The other inter-State applications lodged by Ukraine against Russia and currently pending before the
Court are the following:
Ukraine and the Netherlands v. Russia, applications nos. 8019/16, 43800/14 and 28525/20, lodged
respectively on 1 March 2014, 13 June 2014 and 10 July 2020. These cases concern events in Eastern
Ukraine, including the crash of Malaysian Airlines flight MH17, which was shot down in July 2014.
The applications are pending before the Grand Chamber.
Ukraine v. Russia (re Crimea), applications nos. 20958/14 and 38334/18, lodged on 13 March 2014
and 10 August 2018. The case concerns allegations by Ukraine that the Russian Federation should be
held responsible for an administrative practice comprising numerous violations of the European
Convention on Human Rights in Crimea (“Crimea” refers to both the Autonomous Republic of Crimea
(ARC) and the City of Sevastopol). The application was declared partly admissible by the Grand
Chamber on 14 January 2021. A Grand Chamber judgment will be delivered at a later date.
Ukraine v. Russia (VIII), application no. 55855/18, lodged on 29 November 2018. The case concerns
the naval incident in the Kerch Strait in 2018 which led to the capture of three Ukrainian naval
vessels and their crews. The case is currently pending before the First Section of the Court.

And in any war many innocent people will die. Wars have their own dynamic, and we cannot predict long term effects. It will make a bad situation worse. What Russia, in my opinion is doing is correct course of action. The sad truth, my friend is we do not live in a world, where there are easy answers. Non-violence is the key. I fully understand the urge for kinetic action, but such actions more often than not create way more problems than they solve.

You raise some good points. Yes, filing a complaint is a good legal step…. Naturally it is better to talk than to start a war. However your comments contain the answer: if you state that Soviet military intervention caused the collapse of the USSR…then imagine what a massive hyper-military budget will do to the USA….just let them spend the funds… (they will just print more and create an even bigger hyperinflation than they will anyway eventually have to face)…just let them get all their forces into position (the US is in no shape to deploy adequate forces on the same timescale that Russia can …that has now been decisively proven…). The US Military is now fully aware that if they aim to fight this issue, Russia can destroy the US before any US troops have even entered the Ukie Theatre. Putins Red Line was clear.

There is a dramatic tale to tell – which for some reason has been hushed up. Findings
On March 6th, 2017, hearings began on Ukraine’s application for preventive measures, which lasted until March 9th.[2] Preventive measures will allow the Court to prevent the deterioration of the situation and to protect the civilian population for the length of time necessary to hear the case. Consideration of the merits of the claim will continue regardless of the Court’s ruling on the request for the application of preventive measures. On April 19, 2017, a precautionary decision was announced. The International Court of Justice in The Hague ruled that Russia should refrain from imposing restrictions on the Mejlis of the Crimean Tatar People and allow it to resume its activities.[3][4] The ICJ denied Ukraine approval of provisional measures against Russia on prohibition of terrorist financing.[5] On November 8th, 2019, the court found that it has jurisdiction to hear the case on the basis of anti-terrorism and anti-discrimination treaties over Russia’s alleged support for separatists in Crimea and eastern Ukraine. Also the ICJ rejected Moscow’s call on preliminary objections.[6][7]
Attempting to go through the ICJ judgements its too complicated for me….so am not sure the case wholly or partly failed… I (of many believed it to be an absurd travesty of the truth of course)seem to recall the case had foundered to quite an extent….some “remedies” are compulsory or advisable ….whether it continues or under appeal or even Russia has recognised any part of it following its attempts to say the ICJ had no jurisdiction to hear the case.
Maybe-surely- the “evidence” presented by Ukraine has been deeply analysed to be turned back against Ukraine in this new action by Russia(not returning to the ICJ to present this….maybe later?)….may I ask again if the Donbass “Whitebook” of Ukraine crimes against its peoples is included?

I read a article five years ago by a military analyst that stated that for the time being Russia would remain calm, quite militarily. They would not make any threats and work on diplomacy and communication with their adversaries.
However, during this time the analyst predicted that which has happened. Russia would build its military capability and introduce new advanced weaponry that no one else could even dream of.
In conclusion this analyst stated that their would be no war with Russia and the West UNTIL…… Russia had fully tested and deployed the S-500 anti-missile system which was the all-time game changer.
Guess what. The S-500 is being rolled out NOW. It will be in full deployment very soon.
Once roll out is complete, THEN there will be war or a very serious coercion to PEACE.
Russia is just laying the ground work for some very serious “discussions” to come.

The EHCR will abide by the latter of course but, by now, Russia’s achievements are seriously making themselves felt everywhere. EU’s collective dementia backing up a bunch of Ukronazis who botched it all along the line will soon be ’rewarded’ accordingly as Russia unceremoniously takes the ruined fiefdom of Ukraine back at a suitable stage of its irreversible ongoing depopulation. The idea here is not to get any approval from silly, malevolent Euro-trash. Once the complaint gets rejected, Russia will resort to real force. Given all the pretensions, arrogance and delusions of her adversaries, Russia knows full well they’re simply too stupid to make the smarter move: pretend to take the complaint seriously while covertly arming and goading the Ukronazis. Russia will just smash Ukraine and refer to the violations highlighted in the filed complaint as Russia’s casus belli. The Euro-trash will not approve — how sad (not).
