It appears that the Russians got tired of waiting. I suggest that you all carefully parse the Statement of the Russian Ministry of Foreign Affairs I posted earlier today. This is an interesting document because besides an explanation of the Russian decision to move it, it is also, potentially, a legal defense or an unprecedented Russian decision: to overtly violate the Ukrainian sovereignty. Let me explain.
First, the case of Crimea was also a “special case”. The Russian were legally present there and, in the Russian rationale, all the “Polite Armed Men in Green” did was to protect the local population to make it possible for the latter to freely express its will. Only after that will was expressed did Russia agree to formally re-incorporate Crimea into Russia. So from the legal Russian point of view, none of the Russian actions in Crimea included any form of violation of Ukrainian sovereignty. I know, most western analyst will not agree, but that is the official Russian stance. And official stances are important because they form the basis for a legal argument.
Second, the aid which Russia has been sending to Novorussia has been exclusively covert. Covert operations, no matter their magnitude, do not form the basis for a legal position. The official position of Moscow has been that not only was there absolutely no military aid to Novorussia, but even when Ukie artillery shells landed inside Russia did the Kremlin authorize any retaliation, again in (official) deference to the Ukrainian national sovereignty.
This time, however, there is no doubt at all that the Russians did deliberately and officially chose to ignore Kiev and move in. Now, in fact, in reality, this is clearly the logically, politically and morally right thing to do. But in legal terms, this clearly a violation of Ukrainian sovereignty. From a legal point of view, the Ukies had the right to keep the Russian convoy at the border for another 10’000 years if they wanted and Russia had no legal right to simply move in. What apparently happened this morning is that the Ukie officials did not even bother showing up, so the Kremlin just said “forget it!” and ordered the trucks in.
Not only did the Russians move in, but they did that without the ICRC whose personnel refused to go because of the lack of security guarantees from Kiev. The Russian response to that lack of security guarantees was a) to order this unarmed convoy in and b) to clearly state in the official statement:
We are warning against any attempts to thwart this purely humanitarian mission which took a long time to prepare in conditions of complete transparency and cooperation with the Ukrainian side and the ICRC. Those who are ready to continue sacrificing human lives to their own ambitions and geopolitical designs and who are rudely trampling on the norms and principles of international humanitarian law will assume complete responsibility for the possible consequences of provocations against the humanitarian relief convoy.
Again, from a logical, political or moral point of view, this is rather self-obvious, but from a legal point of view this is a threat to use force (“complete responsibility for the possible consequences”) inside the putatively sovereign territory of the Ukraine.
The US and their main agent in Kiev, Nalivaichenko, immediately and correctly understood the threat: not only did this convoy bring much needed humanitarian aid to Lugansk, it also provided a fantastic political and legal “cover” for future Russian actions inside Novorussia. And by “actions” I don’t necessarily mean military actions, although that is now clearly and officially possible. I also mean legal actions such as recognizing Novorussia. From their point of view, Obama, Poroshenko, Nalivaichenko are absolutely correct to be enraged, because I bet you that the timing, context and manner in which Russia moved into Novorussia will not result in further sanctions or political consequences. Russia has now officially declared the Ukie national sovereignty as “over” and the EU will probably not do anything meaningful about it.
That, by itself, is a nightmare for Uncle Sam.
Furthermore, I expect the Russian to act with a great deal of restraint. It would be stupid for them to say “okay, now that we violated the territorial integrity of the Ukraine and ignored its sovereignty we might as well bomb the junta forces and move our troops in”. I am quite confident that they will not do that. Yet. For the Russian side, the best thing to do now is to wait. First, the convoy will really help. Second, it will become a headache for the Ukies (bombing this convey would not look very good). Third, this convoy will buy enough time for the situation to become far clearer. What am I referring to here?
The Ukie plan has been to present some major “victory” for the Sunday the 24, when they plan a victory parade in Kiev to celebrate independence day (yup, the US-controlled and Nazi-administered “Banderastan” will celebrate its “independence”… this is both sad and hilarious). Instead, what they have a long streak of *very* nasty defeats during the past 5-6 days or so. By all accounts, the Ukies are getting butchered and, for the first time, even pushed back (if only on a tactical level). That convoy in Luganks will add a stinging symbolical “f**k you!” to the junta in Kiev. It will also exacerbate the tensions between the ruling clique in power, the Right Sector and Dmitri Iarosh and the growing protest movement in western Ukraine.
Bottom line: this is a risky move no doubt, probably brought about by the realization that with water running out in Luganks Putin had to act. Still it is also an absolutely brilliant move which will create a massive headache for the US and its Nazi puppets in Kiev.

PS: I heard yesterday evening that Holland has officially announced that it will not release the full info of the flight data and voice recorders of MH17. Thus Holland has now become an official accomplice to the cover-up of this US false-flag operation and to the murder of the passengers of MH17. Most interestingly, in his words before the UNSC, Churkin not only pointed out that the Security Council had voted last July “for Resolution 2165, which authorized direct supplies of humanitarian assistance to Syria without the country’s government”, but also said that Russia had received permission from Kiev on August 12. He then continued,
“I can say once again that we received official consent from them. We discussed that issue. If they deceived us, it is their problem. We just wish to give help to those who need it.”
Not only is this convoy the moral thing to do — and Russia the only country in the world to step forward and do it, but wow, was there planning involved: every “i” dotted, every “t” crossed, and a perfect double bind for every single psychopath from Tel Aviv to London to Washington to Kiev, and every satrapy in between. Just like with MH 17, Russia simply furnishes the rope and sits back while we climb on the chair, place it on our own necks and keep tightening away. That’s an awful metaphor and I really don’t want to continue it, but the stupidity of whoever’s in charge of all we’ve done in Ukraine is truly, truly impressive. Great points as usual. If @BradCabana is correct more bad news for the junta forces this weekend is looming with the NAF assaulting Amvrosiivka. If that city falls, then the NAF can work their way along the Russian border blasting away at exposed Ukie border guard units creating a solid front for an assault on Mariupol itself — a total nightmare for the junta because they won’t be able to even pretend they’re not losing at that point. As Saker readers know the Ukies have spent a lot of resources and deployed their most vicious Azov Battalion Nazis to hold Mariupol. The Poles and Balts could send more troops in to the point of overt intervention, but that entails its own risks. Including that the economic sanctions already hurting them could be accompanied by gas supply interruptions or further sanctions on non-agricultural Baltic and Polish exports to Russia. Canada has a government just ridiculously neocon enough to overtly send troops to Ukraine which would thrill the huge Ukie lobby in Canada but there is no stomach among the Canadian general public to get involved in Ukraine. Neither is there for the American public but Obama and much of Washington seems desperate to get into Syria and will now use ISIS as the pretext for direct US intervention there, aiming for assaults on the more exposed eastern parts of Syria first to test how Assad and Putin react. Since the US is going to be committing more forces to the Middle East — and it looks like East Asia with the Chinese jets buzzing American spy planes — US military power is getting spread awfully thin and the rest of NATO looks like a paper tiger. Polish troops might go to Lviv but openly ride their Leopard tanks into the ATO zone and join their dead Polish merc brothers in arms who’ve died flying Su-25s or MiG-29s over Novorossiya? Having spent too many hours on MH17 I did not realize until today that you had written your analysis on MH17 some time ago.
I have just read it and it is simply amazingly, incredibly accurate in my opinion.
I needed the help an ex Boeing USAF engineer to get even close to where you got to. One fact I learned from him (Raymond Blohm) was that aero engines are designed so the can (the outer cover) is strong enough to resist an exploding turbine blade, so the R60 may not have done any other damage to the aircraft.
My only area of disagreement is about the BUK radar (not necessary for the R60 – as someone else said) and the plan itself. I believe the BUK batteries were plan A and that the BUK radar team switched the radar on in readiness. Plan B was a Ukie back-up plan with the SU-25/s.
But something happened to the launch squad. These guys are techies. Maybe they just could not bring themselves to do the act – they chickened out as some said – or maybe as Robert Parry suggests they had been drinking. Maybe it was a technical fault. Anyhow, the BUK, as you say, would have blown the plane out of the sky – no pilot talk, lots of witnesses seeing a thick missile trail coming from rebel territory, very difficult to counter even with the Russian satellite images. Plan B, the Su-25 would be a nightmare to cover up. The CIA, if involved, would have aborted the mission. But this Ukie bunch, as we know, is both stubborn and dumb.

At this point it looks like our only hope is that one of the Dutch or Brit investigators leaks out the ATC audio, since it will be determined ‘irrelevant’ and ‘nothing out of the ordinary’ until the cockpit recorder goes silent. All of the instructions from Kiev and Dnetropetrovsk ATC to MH17 pilots will not be released because the risk of the Ukies screwing up and releasing (or having Russian intel infiltrate their MH17 ‘team’ and release) a redacted version that doesn’t correspond to the Dutch/Brit version is too great. Instead they will just insist it’s all boring Kiev and Dnetropetrovsk ATC comms with MH17 and anyone who says otherwise or hints that the final part of the tape was cut is a conspiracy theorist loon or Kremlin disinfo agent.

One important point: Even if Russia overtly violates Ukrainian sovereignty, a humanitarian convoy is still a humanitarian convoy. Shooting at it is a war crime.
One truck seems to have been hit by shrapnel from a mortar. Hitting the convoy would naturally give Russia the excuse to send troops to Ukraine. It is possible it would trigger Russian intervention. This seems what the war criminals targeting the convoy are betting on.

Tomorrow on Independence Day Kiev will parade Tockha ballistic missiles and BM-30 Smersh MRLSs for Angela Merkel to see. The same weapons were used today to target civilian areas in Donets and Lugansk. Are they really this proud of their crimes?

The hope is that those convoys won´t stop and keep running through the winter, Russia owes that much to NovoRussia.

It was clear before the Dutch Safety Board’s Aug. 20 announcement that they fully intend to obstruct any real investigation and withhold evidence. The first bad sign was July 22, when the black boxes were handed by the militia to the Malaysians who handed them to the Dutch who handed them to the Brits. Uh-oh.
Then on July 25 the DSB announced they were planning to release “initial factual findings” on Aug. 01 or shortly after. According to the US News & World Distort, “The Dutch Safety Board leading the international investigation into the downing of Malaysia Airlines Flight 17 says it expects to publish “initial factual findings” soon. A spokeswoman said Friday that such findings could be published as early as the end of next week, and will likely provide a picture of how the investigation will proceed. In the absence of a leak or hacking exploit, there will be no data from the DSB. They will release only what they are told and when they are told. The timing probably will coincide with a major event that drowns out the story, or perhaps over a holiday when everyone is distracted.
Saker expressed hope that the Malaysian government will not allow the cover-up of this obvious false flag operation. While I share that hope I know that past behavior is the best predictor of future behavior. Malaysia already has raised insufficient hell about the disappearance MH370. My take is that if the MH17 report contains nothing negative about the crew’s actions or the airline then Malaysia will issue no more than a mild protest. I’ve love to be wrong about this.
The high ground is valuable in combat. I believe that the moral high ground is also of great value in warfare of a different sort. The U. S. works on the theory that whoever speak earliest and loudest wins, and they’re very good at it. The U. S. owns this strategy, and Russia for many reasons can’t compete and shouldn’t try to compete. However, Russia can and should hit ’em where they ain’t, which is the moral high ground. Russia did this on July 21, releasing the truth backed by hard evidence to counter the early-loud lies from the U. S. and their MSM mouthpieces. Suddenly MH17 changed from a potential casus belli to something the U. S. and the MSM didn’t want to talk about. Russia has seized the high moral ground again with this in-your-face humanitarian convoy, and the whole world is watching. Only Russia has the means, motive and opportunity to put MH17 back into the MSM headlines by once again telling more of the truth. The timing will be of their choosing. Maybe in hindsight we will understand why they’ve been waiting.

True story. One of these “persons” moved to my hood. Most people here use a lawn service. Not us. We’re the frugal type. And like to tend our garden. These new folks didn’t have a mower or a service. So my son cut their grass to be a good neighbor. Whilst he was cutting, the DOS husband came home, got out of his car, and walked past my son without as much as a simple “hello”. My son didn’t say anything — but the rest of his time home this summer I couldn’t get him to mow their lawn again.

Russia’s growing military presence in the Arctic is a concern and Canada should not get complacent about it, Prime Minister Stephen Harper said Friday during the second leg of his annual northern tour.
Harper, who was in the Northwest Territories town of Fort Smith to announce initiatives to promote fresh food production in the region, said Russia has not made the same sort of aggressive military incursions in the Arctic as it has in Eastern Europe.

But the prime minister gave a “cautious yes” when asked if he was concerned about the militarization of the Arctic.
“Cautious in the following sense: that we haven’t seen, obviously, the kind of aggressive moves in the Arctic that we have seen in eastern Europe by the Russians,” Harper said.
“In fact, we have actually seen the Russian government … actually operating within international rules.
“However, I don’t think — because of what’s happening elsewhere and because of what’s happened for many years now — we should be complacent about this.”
Russian planes testing Canadian boundaries
Russia is busy rebuilding former Soviet-era military bases in its north, and has a fleet of nuclear-powered submarines and icebreakers patrolling its waters. Russian planes have also tested the boundaries of Canadian airspace, Harper said.
“I just think we should not be complacent, because we have seen over the period that President Putin has been in power just a gradual growing in aggressiveness of his government toward neighbours and the gradual military assertiveness of that country, and I just think it’s something we should never be too at ease about,” he said.
In the coming days, the prime minister will take part in a series of military manoeuvres in the Northwest Passage meant to assert Canada’s Arctic sovereignty.
Harper also called on Russia to withdraw a convoy of trucks that crossed across its border into Ukraine in what Moscow said was part of a humanitarian mission but which the Ukrainians called a “direct invasion.”
Earlier, the prime minister said the federal government will spend $2 million to build a permanent campus for the Northern Farm Training Institute in the Northwest Territories town of Hay River.
The money will let the two-year-old school run programs year-round from a campus set on 300 acres of farmland with greenhouses, offices and classrooms.
A news release said the school could earn extra money by selling its produce and flowers.
Harper also said up to $2 million will be spent on an initiative that’s meant to commercialize and enhance the productivity of greenhouse projects across the North.

I feel that Saker’s analysis of Russia’s “legal position” is missing fundamental aspects.
Russia seemed to give up publicizing these probably because the relevant facts were simply ignored by NATO whenever they were brought up, and legal formalisms are not the strongest popular motivation (although NATO is happy to moralize about Russia’s violation of legal formalisms while ignoring legalisms not in the Kiev junta’s favor), but it’s notable that NATO never really tried to provide counter-points or argue Russia’s legal position, they just ignored it. I recall even a NATO-centric website “Lawfare” having an article which happened to affirm Russia’s legal position, although the topic was never given more broad attention.
1) In Crimean events, Russia was invited by the legitimate Ukrainian President Yanukovych to protect UKR citizen’s rights. AFAIK, this request was never limited to the territory of Crimea, but applied to all of Ukraine. Even if this did not apply to all of Ukraine, the fact remains that there is no legitimate Ukrainian government, meaning Ukrainian state sovereignty is lapsed in a state of civil war/chaos akin to Somalia. There is currently no legit UKR government to protest/contest Russian actions, NATO has never been legitimately granted title to UKR sovereignty.
2) Russia NEVER recognized the Kiev junta’s legitimate Ukrainian government, they agreed to cooperate on case by case basis, but not granting the junta recognition as such, i.e. simply as ad hoc cooperation with one faction in a de facto civil war lawless Ukraine. NATO rushed to recognize the junta, blatantly ignoring legal details, but Russia never did so.
Along with illegitimacy of Presidential switch itself, that tainted the stacking of Constitutional Court, the replacement of the Constitution itself, and of course the use of UKR armed forces against UKR citizens on UKR territory remains illegal, as is the state sponsored creation of “patriotic” militias.
I just don’t see any fundamental change of Russian position given the above, and I believe the only scrap of legitimate UKR sovereignty remaining would be Yanukovych’s request to Russiat to protect UKR citizen rights vs. Kiev junta impositions, which would include rights to self determination as per international law (with no remaining legitimate judiciary to rule UKR law over-rides that).
The above is admittedly rather “threadbare”, but if one is discussing legal formalisms, that which lies even the slightest distance on the side of legally proscribed is in fact the legal position, and that certainly seems to be in Russia’s favor, NATO hysterics aside. NATO hysterics seek to persecute Russia over violations of legal formalisms (e.g. rather than relying on claims of direct violence/etc vs. citizens, as in Crimea), yet is forced to ignore rafts of OTHER legal formalisms which would pull the rug from under their entire position backing the illegal Kiev coup.
BTW: Did you ever hear what happened to the judges, lawyers, law scholars in Odessa who (some months ago) were prevented by “patriotic” thugs from holding a meeting on the topic of the junta/coup regime?

Creating a provocation that achieves: sabotaging EU-Russia ties, weakening the EU further to the point it NEEDS to increase cooperation with US, and justifying further NATO military expansion and “global posture” against Russia (and logically, any allies) are all actually plausible goals for the USA to aim for with this “adventure”. The final state of affairs in Ukraine itself is really irrelevant to them.

The results of the investigation of MH17 crash classified. On August 8 Ukraine, the Netherlands, Australia and Belgium on August 8 signed an agreement not to disclose information obtained in the course of the investigation.
According to UNIAN correspondent, in Kiev Speaker prosecutor Yuri Boychenko. said that the results will be announced on completion of the investigation, and only if, there is consensus agreement of all the parties who signed the agreement.
Any of the signatory countries have the right to veto the publication of results of the investigation without explanation..
Only after the conclusion of this agreement the Verkhovna Rada of Ukraine ratified the agreement on sending Malaysian personnel to investigate the disaster in the Donetsk region.

calls for a cease fire in Novorussia and extending “an offer” to the Novorussian population. The aim must be federalization as that will be the only way of ensuring Ukraine’s territorial integrity. Gabriel also says that nobody currently assumes that Russia’s annexation of Crimea can be quickly reversed.
Now that could be a significant development. The point is that Gabriel is arguably the most powerful politician in Germany, more powerful than Merkel, because he could unseat Merkel at any time of his choosing. A Gabriel-led coalition consisting of the social democrats, the overtly communist left and the Greens would enjoy only a slight majority in parliament but still. (That’s why the Merkel government is for all intents and purposes already pursuing socialist policies. Not that Merkel, in her previous life a very loyal low-level politician in East Germany, would mind.)
So, Gabriel is certainly not an insignificant politician just trying to
put himself into the limelight. Common wisdom holds that he is working towards replacing Merkel as chancellor possibly already in 2015. There are two fronts he has to work on: First, making it acceptable to form a coalition with the “left” party, which actually consists the former ruling party of East Germany under a different name and some left-wing elements from the West. The left party has deviated somewhat from the political mainstream with regard to the crisis in Ukraine, with some of its leading figures arguing openly against Western policies. The second front consists of Gabriel, who has a very mediocre background as an elementary school teacher, making himself acceptable to German elite circles especially in the economy. It is an open secret that German industrial leaders are unhappy about the sanctions and the whole direction in which the confrontation with Russia is going. Gabriel is obviously trying to score some points here.
The fact that he is positioning himself in this way right now might, just might suggest that a rift is finally developing between the EU and the US. Gabriel himself is an intelligent if unsophisticated, unimaginative and narcissistic schoolyard bully type of character. To speculate a little bit, he has very probably not come up with what he is saying all by himself but has been advised by more experienced social democrats the like of former chancellor Helmut Schmidt. We will see were it all leads to.

These politician and media types keep behaving as if there is no internet around, where their actions and statements are analysed and commented. In the long term this must further undermine their credibility. Revolutions have happened through history and there is no reason why there won’t be one in the future.
Maybe we should give the Dutch investigators a chance to bring out their report first, before jumping to conclusions. Perhaps they are going to avoid blaming someone, but their goal is still to state the reason why the plane was downed, and obviously there is a strong correlation between the reason (buk, a2a, machine gun fire) and the perps. There are now millions of online Sherlock Holmes around who are eager to jump on the report and tear it to pieces, just like was the case with 9/11, that is still a pain in the rear for the authorities and a potential sword of Damocles over their heads.

At the same time the main stream media, accomplices to said crimes, lie, obscure,distort, and manipulate so that we do not know what the “democracies” of the Western world are doing. Also, to the idea of Russia’s aid convoy being a change re: Ukraine/Kiev’s sovereignty, even the not-recognized-as-legit-UKR-gov junta regime itself already did officially authorize Russia to do so on Aug 12th, right? The last holdups were beaurocratic details for import/border control, but Russia didn’t really use a junta-controlled crossing. Russia is not obligated to perform or facilitate Ukraine’s import control tasks for it, that is Ukraine’s sovereign task, and if it can’t because it doesn’t control the border, so be it: that border crossing still is an official one by legitimate orders of Ukraine, so Russia is doing nothing wrong by using it.
Also, the illegitimate junta in Kiev has demonstrated time after time that the only thing it is reliable for is to tell lie after lie (from Geneva accords almost immediately broken, to lies big and small about the ongoing conflict). Why would Russia be remiss in assumming the junta border control was LYING about remaining paperwork being needed? Why should any objective observer not also doubt the junta’s claims that there was further requirements needed?

In above-ground nuclear testing, they did (1) because they had to with the technology that existed then. They did (2) because they were trying to maximize the explosive power of the weapon, so they had to have a thick steel casing that would hold things together for as many milliseconds as possible. What little they knew then about EMP was mostly regarded as a nuisance.

Then, about Merkel to travel to Kiev, for negotiations. Final sentence: “In light of recent events, though, it is not clear whether Ukraine will be in a Position to negotiate any terms at all.”
What is the economic future for Novorossia? It can only be in the realm of state capitalism, socialism, communism. Antifascism is the reality and the ideology that drives the resistance – but – now matter how much aid Mother Russia delivers, now or later, the people have to live on the land and with each other. The identity of the people is bound up with the Great Patriotic War and the Soviet Union. There can be no escaping the destiny of Novorossia. Perhaps that is what the West is really opposed to – a new socialist state. Not so much ‘Russia / New Russia’ – but the very creation of a new anti-capitalist state. The legacy of Soviet Ukraine will not be so easily erased from the pages of history, and not only in the Southeast.

Just heard from Italian MSM: they’re saying Putin was convinced by Merkel to order a u-turn and get the trucks back into Russia. Not a word about the trucks actually reaching Lugansk and unloading. MSM picture is Putin getting scared by NATO and backing up in terror, which is a new low in the pile of steaming bullshit these so called journalists have fed us.
Always, someone, a brave and worthy person, had to take the first step to change things.
I do not know of humanitarian law, but if this action by the Russian government was legal, do you imagine what it would mean for every crushed to the earth?

Accompanying the initiative of the Italian Music band Band Bassotti and Italian convoy, is organizing a caravan of the Basque Country with the slogan ” Gu ere bagoaz” (“We are also going”) to go together.
To present the Basque Antifascist Brigade, inform people about events in Ukraine and raise support, funding, volunteers, a weekend of solidarity is organized this coming 5th and 6th September at the Navarre town of Alsasua. There will be a lecture by political scientist at the University of the Basque Country, Asier Blas, entitled “Fascism in Ukraine and popular resistance in the Donbass” in addition to concerts.
